From the Kansas State Supreme Court:

The defendant, the State of Kansas (appellant/cross-appellee), appeals from various holdings by a three-judge district court panel.

The panel's holdings included a determination that the State violated Article 6 when the legislature underfunded K-12 public education between fiscal years 2009 and 2012, as well as a related determination that the legislature failed to consider the actual costs of providing a constitutionally required education before making its funding decisions.

Its holdings also concluded that additional constitutional violations occurred because the legislature either withheld or reduced certain funding to which school districts were statutorily entitled.

In my estimation the Brownback Administration and the Kansas GOP owe billions in back taxes to the Kansas Public Education system.

Any change in public education funding should be approved by the voting taxpayers aka the largest group of public education stakeholders.

Public education has for decades and decades been one of the government success stories in reality a best bang for the tax buck.

A bill (SB 56) recently passed the Kansas Senate Committee on Corrections and Juvenile Justice would make it possible to bring criminal charges against Kansas schoolteachers – just for doing their jobs. But you can stop this bill before it becomes law.

This bill would make it a crime for K-12 public, private and parochial teachers to teach or discuss material deemed “harmful” to minors. According to the bill, “harmful material” could include anything depicting nudity or sexual conduct (goodbye, sex education courses!) or that mentions homosexuality or sexual excitement (good riddance, classic literature!).

Tell your Kansas Legislators that teachers should not be criminalized for doing their jobs.

Under the broad definitions included in the bill, just about anything could be considered “harmful” to minors – and land the teacher in jail – if someone, somewhere objects to it. Even the distribution of educational materials that have been reviewed by school administrators and deemed age appropriate could result in teachers serving six months in jail.

I joined with many other concerned Kansans in Topeka and testified against this bill because it would have an immediately chilling effect on our schools. If a teacher is afraid that they’re going to be charged and convicted of a misdemeanor for doing their job, they’re going to be a lot less likely to share any information that someone – anyone – anywhere in Kansas might object to.

Censorship like this is wrong, unfair to teachers doing their jobs, and harmful to the education of our children.

Although this bill passed in committee, the full Kansas Senate has not yet voted on it. There is still time to take action and stop SB 56 from threatening our educators and censoring our children’s education. Contact your members of the Kansas Legislature and tell them that you oppose SB 56.
